Defense Verdict on all Counts

John Tinney, Jack Tinney, and Kim Fields joined with the Dallas, Texas firm of Locke, Liddell & Sapp in defending drug manufacturer Schering-Plough Corporation and its two subsidiaries, Schering Corporation and Warrick Pharmaceuticals, in a suit brought by the West Virginia Attorney General on behalf of three state agencies.
The alleged claim was for fraudulent manipulation of the average wholesale price (AWP) of generic drugs, which resulted in state agencies over-reimbursing pharmacies - In other words, price-fixing to gain market share.
The trial began on November 28 and ended on December 8 with a defense verdict on all counts. The jury deliberated less than thirty minutes before returning the verdict.
